These Terms of Service govern your use of the Rize application operated by AxJ Fitness Ltd, incorporated in England and Wales ("we", "us", "our"). By using the App you agree to be bound by these Terms.
1. ELIGIBILITY
You must be at least 16 years of age to use this App. By using the App you confirm you meet this requirement and have the legal capacity to enter into this agreement.
2. DESCRIPTION OF SERVICE
Rize is a personal nutrition and wellness tracking application. It is intended for general informational and personal wellness purposes only and is not a substitute for professional advice.
3. NOT MEDICAL ADVICE
IMPORTANT: The App does not constitute medical, clinical, nutritional, or health advice. Rize is not a regulated medical device and must not be used to diagnose, treat, cure, prevent, or manage any medical condition. Always consult a qualified healthcare professional before making changes to your diet or exercise programme.
4. EATING DISORDER SAFEGUARDING
Calorie counting may be harmful to individuals with or at risk of eating disorders. Seek guidance from a healthcare provider before using this App if relevant. Beat Eating Disorders: 0808 801 0677 or beateatingdisorders.org.uk.
5. USER ACCOUNTS AND SECURITY
You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at Support@rizenutrition.co.uk of any suspected unauthorised use.
6. ACCEPTABLE USE
You agree not to use the App for any unlawful purpose, attempt to probe its security, reverse engineer it, transmit harmful content, or impersonate any person or entity.
7. INTELLECTUAL PROPERTY
All content, trademarks, and intellectual property within the App are owned by or licensed to AxJ Fitness Ltd. The name "Rize" and associated branding are trademarks of AxJ Fitness Ltd. Nothing in these Terms grants you any right to our intellectual property.
8. FOOD DATABASE AND NUTRITIONAL DATA
Nutritional data is derived from USDA FoodData Central, McCance and Widdowson's Composition of Foods, Open Food Facts, and manufacturer data. Values may differ from actual food composition. We make no warranty as to accuracy. Use at your own risk.
9. USER-GENERATED CONTENT
Content you create in the App remains your property. You grant us a limited licence to store and process it solely to provide the App's services. We will not sell your content.
10. THIRD-PARTY SERVICES
The App may integrate with Apple Health, Google Fit, and Samsung Health. Your use of those services is governed by their respective terms. We are not responsible for third-party data practices.
11. DISCLAIMER OF WARRANTIES
The App is provided "as is" without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, or that nutritional data will be accurate. To the fullest extent permitted by law, we disclaim all implied warranties.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law, AxJ Fitness Ltd shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed £50 or amounts paid by you in the preceding twelve months, whichever is greater.
13. INDEMNIFICATION
You agree to indemnify and hold harmless AxJ Fitness Ltd from claims arising from your use of the App, breach of these Terms, or violation of any third-party rights.
14. TERMINATION
Either party may terminate this agreement at any time. We may suspend access without notice for breach of these Terms. Clauses 7, 11, 12, 13, 15, and 16 survive termination.
15. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of England and Wales. Contact us at Support@rizenutrition.co.uk to resolve disputes informally. Unresolved disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
16. CONSUMER RIGHTS
If you are a UK consumer, you may have rights under the Consumer Rights Act 2015 that cannot be excluded by these Terms.
17. CHANGES TO TERMS
We may modify these Terms at any time. Material changes will be communicated via in-app notification or email. Continued use after changes constitutes acceptance.

AxJ Fitness Ltd ("we", "us", "our") is committed to protecting your personal data. This policy explains how we collect, use, and protect your information when you use the Rize application, and sets out your rights under the UK GDPR and Data Protection Act 2018.
1. DATA CONTROLLER
The data controller is AxJ Fitness Ltd. Contact us at Support@rizenutrition.co.uk for all data protection queries. We aim to respond within 30 days.
2. DATA WE COLLECT
We collect: (a) Account data - email address and display name; (b) Profile data - date of birth, height, weight, gender, and activity level you voluntarily enter; (c) Nutrition and health data - food diary entries, macro and micronutrient logs, body weight and measurement records; (d) Device data - device type, OS version, and anonymous crash reports; (e) Usage data - anonymised feature statistics.
3. SPECIAL CATEGORY DATA
Nutrition and body composition data may constitute special category data under Article 9 UK GDPR. We process this only with your explicit consent, given when you enter this information. You may withdraw consent at any time by deleting your account.
4. LAWFUL BASES FOR PROCESSING
We rely on: (a) Contract performance - to provide the App; (b) Legitimate interests - to improve the App and ensure security; (c) Legal obligation - to comply with applicable laws; (d) Explicit consent - for special category health data.
5. DATA STORAGE AND SECURITY
Data is stored locally on your device by default. Where cloud features are enabled, data is transmitted over TLS-encrypted connections to servers within the UK or EEA. We implement encryption at rest and in transit and access controls to protect your data.
6. DATA RETENTION
We retain data for as long as your account is active. Upon account deletion, we delete or anonymise your data within 30 days, unless retention is required by law.
7. SHARING YOUR DATA
We do not sell your data. We may share data with: (a) Service providers bound by data processing agreements; (b) Authorities where required by law; (c) Successors in the event of a business transfer, subject to the same privacy protections.
8. THIRD-PARTY INTEGRATIONS
If you connect the App with Apple Health, Google Fit, or similar services, data exchanged is governed by those services' privacy policies. We do not share health data with third parties.
9. FOOD DATABASE AND ATTRIBUTION
Nutritional data is sourced from USDA FoodData Central, McCance and Widdowson's Composition of Foods, and Open Food Facts (Open Database Licence). Contact Support@rizenutrition.co.uk if you believe any data infringes a third-party right.
10. YOUR RIGHTS UNDER UK GDPR
You have the right to: (a) access your data; (b) rectification; (c) erasure; (d) restriction of processing; (e) data portability; (f) object to processing; (g) not be subject to solely automated decisions. Contact Support@rizenutrition.co.uk to exercise these rights.
11. LOCAL STORAGE AND TRACKING
The App uses device local storage to save your diary, goals, and settings. We do not use tracking cookies or third-party advertising technologies.
12. CHILDREN'S PRIVACY
The App is not intended for children under 13. Contact Support@rizenutrition.co.uk immediately if you believe a child has provided data.
13. INTERNATIONAL TRANSFERS
Data is processed within the UK and EEA. Any transfer outside these territories will be protected by Standard Contractual Clauses approved by the ICO.
14. CALIFORNIA - CCPA RIGHTS
California residents have the right to know what data we collect, request deletion, and opt out of data sale. We do not sell personal data. Contact Support@rizenutrition.co.uk to exercise CCPA rights.
15. BRAZIL - LGPD RIGHTS
Brazil residents have rights under Lei Geral de Protecao de Dados (Law 13,709/2018) including access, correction, deletion, and portability. Contact Support@rizenutrition.co.uk to exercise these rights.
16. CHANGES TO THIS POLICY
We may update this policy from time to time. Material changes will be communicated through in-app notification or email. Continued use after the effective date constitutes acknowledgment of the changes.

You may lodge a complaint with the Information Commissioner's Office (ICO): ico.org.uk, 0303 123 1113. Please contact us at Support@rizenutrition.co.uk first so we can address your concerns directly.
